Australian Immigration for Dummies

This is the shortest most brief tutorial on Australian immigration.

There are three main categories of Skilled Australian Immigration.

1. Onshore immigration
2. Offshore immigration
3. Employer Sponsored (you can be in Australia or outside Australia)


In most cases, the end result of applying for immigration through offshore and onshore immigration is that you would receive the Permanent Resident Visa, class 885,886,175,176. And after having lived in Australia for four years(as of now), you can apply for Australian citizenship. In some cases you might receive Temporary Resident visas which allow you to work and live in Australia for a specific time. After having lived for the specific amount of time, you can then apply for Permanent residency. I will first deal with the onshore migration section and later on discuss the offshore one.
1. Onshore immigration. If you are in Australia

Skilled – Independent (Residence) visa (subclass 885)

A permanent visa for eligible overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study and for holders of certain temporary visas with skills in demand in Australia. Applicants are not sponsored and must pass a points test.

Skilled – Sponsored (Residence) visa (subclass 886)

A permanent visa for eligible overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study and for holders of certain temporary visas with skills in demand in Australia. For applicants not able to meet the Skilled – Independent pass mark, who have either a relative in Australia to sponsor them or a nomination from a State or Territory government. Applicants must pass a points test lower than that for the Skilled – Independent visa.

Skilled – Regional (Residence) visa (subclass 887)

A permanent visa for eligible provisional visa holders who have lived for at least two (2) years and worked for at least one (1) year in a Specified Regional Area in Australia.

Skilled – Regional Sponsored (Provisional) visa (subclass 487)

A three (3) year provisional visa for eligible overseas students and holders of certain temporary visas who can meet the lower pass mark for this visa. Applicants must be either sponsored by an eligible relative living in a designated area of Australia or nominated by a participating state/territory government. After living for two (2) years and working for at least one (1) year in a Specified Regional Area, applicants can apply for a permanent visa.

Skilled – Grduate Temporary Visa (subclass 485)

An 18 month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study. Allows applicants who are unable to pass the points test to remain in Australia for 18 months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa. No points test applies.


All the above categories are mainly designed for International students who have studied in Australia for two years OR for skilled people who are on various temporary resident visas and have skills which are in demand in Australia. Now we will discuss some of the offshore visa options.

2. Offshore immigration. If you are outside Australia

Skilled – Independent (Migrant) visa (subclass 175)

A permanent visa for people with skills in demand in the Australian labour market. Applicants are not sponsored and must pass a points test.

Skilled – Sponsored (Migrant) visa (subclass 176)

A permanent visa for people unable to meet the Skilled – Independent pass mark. Applicants must be either sponsored by an eligible relative living in Australia or nominated by a participating State or Territory government. Applicants must pass a points test lower than that for the Skilled – Independent visa.

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

A three (3) year provisional visa for people who can meet the lower pass mark for this visa. Applicants must be either sponsored by an eligible relative living in a designated area of Australia or nominated by a participating state/territory government. After living for two (2) years and working for at least one (1) year in a Specified Regional Area, applicants can apply for a permanent visa.

Skilled – Recognised Graduate (Temporary) visa (subclass 476)

An 18 month temporary visa for graduates of recognised overseas educational institutions who have skills in demand in Australia. There is no points test for this visa. Employer Sponsored Immigration The employer sponsored immigration has three different categories.

Temporary Visas

For lawfully operating Australian and overseas employers to employ approved skilled workers for temporary vacancies in particular occupations required in Australia. Temporary visas can offer a pathway to a permanent visa.
Skilled Workers Temporary Visa Options

Temporary Business Long Stay – Standard Business Sponsorship (subclass 457)

A program for employers to sponsor approved skilled workers to work in Australia on a temporary visa. Employers can nominate a number of positions for different occupations under the same sponsorship application.

Service Sellers

For representatives of overseas suppliers of services who are negotiating, or entering into, agreements to supply their services in Australia under the General Agreement on Trade and Services (GATS).

Medical Practitioner visa (subclass 422)

Doctors should generally apply for a Temporary Business (Long Stay) visa (subclass 457) but this visa is an alternative for doctors registered to work in Australia. Employers must lodge a separate sponsorship application for each doctor sponsored.

Educational visa (subclass 418)

For educational workers to be employed in Australia on a temporary basis. The sponsoring organisation must be an Australian tertiary education or research institution, school or technical college.

Labour Agreements

Formal arrangements for an Australian industry group or employer to recruit a specified number of skilled workers on a temporary or permanent basis over a number of years.

Permanent Visas

For lawfully operating Australian employers to sponsor skilled workers in particular occupations required in Australia .

Skilled workers Permanent Visa Options

Employer Nomination Scheme (subclass 121/856)

For lawfully operating Australian employers to recruit workers on permanent visas, to fill full-time highly skilled positions which cannot be filled from the Australian labour market.

Regional Sponsored Migration Scheme (subclass 119/857)

For employers in regional Australia to employ skilled people in positions unable to be filled from the local labour market.

Labour Agreements

Formal arrangements for an Australian industry group or employer to recruit a specified number of skilled workers on a temporary or permanent basis over a number of years.

I find your blog very resourceful indeed ! I would like to plan to live and work in OZ. The seemingly easy way is through study. I have graduated 2 yrs back with a Bachelor Degree in IT. Would hence like to pursue a postgraduate but have find the fee really expensive. I'm wondering if you know of any funding or financial aid to study a postgraduate? I have research myself but have not really found any.

If you are going to enrol in course work degree, there is no way to get a scholarship.

Try to apply for research degrees, masters by research, in which you have more chances of getting funded fully or partially.

1. what would be the minimum score for the IELTS for the primary applicant on each module?

2. we dont have much job experience, so would like to know, what type of job will we both be able to get in australia?

3. how much would the living expense ( food ,rent, transport & miscelleneous ) for a couple in NSW be?

You would need to score at least 7 in each of the 4 components of IELTS to be considered for nomination by NSW. NSW also has minimum requirements for work experience and qualifications for some occupations.

Well, to qualify for STNI, you need certain amount of work experience (I think it is 4 years) in the field which is in demand in NSW. So you should read the web document listed above and double check whether you can qualify for STNI in NSW or not.

In offshore applications, it can take up to 7 to 8 months for a case officer to be assigned to you.

Wait till the case officer is assigned to you and he will instruct you for medical etc.

Once a case officer is assigned to you and it takes more then 6 months, contact me and I will help you out.

What does it mean when the automated status email states that "that they have done validity checks" does this mean that my calcution of 120 points is correct. what exactly does the officers allocated look out for apart from health, police checks and employment checks?

I am not sure how they can do validity checks without you having a case officer assigned to you.

I am unable to comment upon the meaning of validity checks.

Normally validity checks means that the document and information you provided have been validated.

No it doesnt mean that your application is worth 120 points.

That will be decided by the case officer and if you have applied online, the system would have informed you whether you would pass the points test or not.

Yes, you are correct. The information I provided earlier regarding accountancy not being on MODL is only for international students.

You will get bonus points for profession being on MODL.

Only international students do not benefit from accountancy being on MODL.

me and my wife both are 26 years old.
1. my wife is the primary applicant. who has completed her bachelors degree in commerce from india. we have completed our vetassess assessment and got a positive mark from them..my wife's occupation is "INTERNAL AUDITOR"and mine is "SALES & MARKETING SPECIALIST(EXECUTIVE)".we have qualified for SIR visa for adelaide.

*We have completed more than 3 years experience in our respective fields..

*my wife got a 7 band in ielts and myself a 6.5 band.

so now our next step is to apply for sponsorship.

now based on this cud u answer the following queries below:

I am unable to understand that in the presence of following

1. You and your spouse have bachelors degrees.

2. Both and your spouse have a profession listed on the SOL/MODL

3. Both you and your spouse have 3 plus yrs of experience in your respective professions.

Why do you want to apply for SIR visa?

Why not directly for a permanent resident visa?

A SIR visa has restrictions attached to it. A permanent visa doesnt have any restrictions attached to it.

Please use the pionts calculator given on my blogs and calculate your points. You qualify for PR.


Now Answering your questions.

Q. What is SIR.

This visa is a three (3) year provisional visa for skilled workers who are unable to meet the criteria for a Skilled - Independent visa.

You will have the opportunity to apply for permanent residency after you have lived for two (2) years and worked at least 12 months in a Specified Regional Area of Australia. Please check the list of regional areas.


This visa requires you to be either:

Nominated by a participating State or Territory government agency

or

sponsored by an eligible relative living in a designated area of Australia.


This visa uses a points test to select visa applicants with characteristics needed in the Australian labour market.

You must:

be under 45 years of age

have good English language skills

have the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL)

Please use the following table to check whether you and your spouse pass the 100 mark points test for a SIR.

Points test for Main applicant

If you and your spouse both have 100 points then you should first apply for a nomination by the state territory.

Participating State or Territory governments will assess your eligibility for nomination under this visa scheme. If a State or Territory government agrees to nominate you for this visa, they will provide you with a reference number which you should include in your application. The department will contact the nominating State/Territory government agency to confirm your nomination.

Obtaining nomination from a participating State or Territory government does not mean that you will be automatically granted a visa. You must also be assessed by this department against a number of visa-specific requirements. You will only be granted a visa if all requirements are met.

Once you are nominated by a state/territory, then you can apply for a visa to the immigration department.

If you pass the points test and you are selected by a state/territory, then I dont see any reason why your application is rejected.

In most cases, the difficult part is to convince the state/territory to nominate you. Read the guidelines for state/territory nomination and make sure you have all the documents ready.

Also it would be good to show a list of jobs you searched on seek.com.au and certain job offers which were made to you.

You can then say to state/territory that you were offered such and such jobs but because you didnt have work rights, you couldnt take up the job.

Just make things up by saying that you actually found jobs but then couldnt take them up because of work rights issue.

Basically there are interested in knowing whether you are really serious in living in that particular state/territory or not.

So try to provide as much documentation of your intentions as possible.

So once you are nominated by state territory, all you have to do is to lodge the application and then wait for a SIR.

Q. Can I get a job easily on SIR in Adelaide.

Ans. That depends on your skills and abilities. If you are really good in your field, then I dont see any reason why you wont get a job.

Q. Chances of PR after 3 years of SIR.

Ans: You can apply for PR visa subclass 887 after SIR if you fulfill the following requirements.

The purpose of visa subclass 887 is to allow holders of certain provisional visas to apply for permanent residency.

To be granted this visa, you must have lived for at least two (2) years and worked full time for a total period of 12 months in a Specified Regional Area of Australia before lodging your visa application.

Who is this visa for?

This visa is for you if you hold one of these visas:

Skilled – Independent Regional (Provisional) visa (subclass 495)

Skilled – Designated Area – Sponsored (Provisional) visa (subclass 496)

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

Skilled – Regional Sponsored (Provisional) visa (subclass 487)

and you:

have lived in a Specified Regional Area for at least two (2) years

have worked full time in a Specified Regional Area for at least one (1) year

have complied with the conditions on your visa.

thank you for your prompt reply...

we have already sent our details to these teritorries and our occupation is listed in the SOL/MODL.(INTERNAL AUDITOR) SO WE got the positive confirmation from the VETASSESS DEPT. and then we were asked to take our IELTS. WE HAVE ALREADY TAKEN THE TESTS AND NOW WE HAVE REACHED THE STAGE OF SPONSORSHIP FROM THE STATE/ TERITORRY.

Now the thing is we are already qualified for 2 types of visas...i.e.-SIR(ADELAIDE /SA) as well as STNI PR for NSW..we Have passed the assesments for both the territories..but as per the STNI rules ,my wife being the primary applicant require the point of 7 in each module of IELTS..but her score is like...listening:8, reading:6.5,writing:6.5 & speaking:7.5..she has tried 3 times to get the required score of 7 in each module but is not able to get the score..that is why we are simultaneously tring for adelaide that is SIR visa as we are qualified for this as per the IELTS score requirement for SA...

can you let us know what can we do about this..is there any other way we can go ahead with this STNI nsw PR???

TO be frank iam very confused to go to adelaide ..as ive spoken to some people who are already thr in adelaide ,,who say tht the job opportunities in adelaide are very very low...they say tht sometimes you cannot even find a job for 2-3 months...if this is the case .what would ur sugesstion be...

my wife has done her post grad in communication media for CHILDREN in which she had to deal with school children as well as special children, she has learnt about the psychology and behaviours of diff children..the problem is she cud not complete her course due to our marraige and hence her final 4th semester was not completed ...thus she doesnt have a DEGREE in hand!! but do u think her 3 semester marksheet documents cud help her get a job in related services for child care or similar ones?? kindly let us know....

and for me i am ready to do any type of job availablle for me...

I think you are not clear about STNI, SIR and PR.


PR is a life long permanent visa which doesnt expire and has no conditions attached to it.

STNI is a permanent visa which requires you to stay and work in a particular region for two years. After those two years your visa is converted into PR when you apply.


SIR is a three years temporary visa. You must live in the area for at least 2 years out of those three years and work for one year out of those 2 years. At the end you have to again apply for PR. There is no guarantee that you will get PR after SIR.

Now keeping in mind the above three definitions, what is your question?

And I am wondering why dont you directly apply for PR as that is what your aim should be.

Ok now that makes it clear.

I now see why your consultant is requesting you to apply for STNI and SIR.

The profession chosen by the primary applicant on the SOL is 2212-13. This profession has 50 points.

Now lets look up your total points.

IELTS: 15 points (If the primary applicant can take 7 in all modules, then the primary applicant will get 25 points.)

Nominated occupation: 50

Age: 30

Specific work experience: 5

Occupation in demand/Job Offer: 0

Australian qualification: 0

Australian work experience: 0

Language Skills/NAATI: 0

Regional Study: 0

State territory nomination: ?

Spouse/Partner: ?

Total Points = 100

Now if you can do two things

1. Get your spouse to get 7 in all bands of IELTS. That way the score of the primary applicant will go up to 110.

2. Then if you, the secondary applicant can also get a positive skills assessment from the respective assessing authority and nominate a profession on the SOL. That way the primary applicants point will go up to 115.

3. Now in the last step, if you can get 5 more points by getting nomination from a state/territory, the total points of the primary applicant will go to 120 and then you can apply for PR which means that you can live, work and study any where in Australia as long as you want. There are no restrictions on the PR visa.

But the primary applicant must get the extra 20 points as of now the primary applicant only has 100 points.

So try to get yourself assessed by the relevant assessing authority. You can do a diploma in marketing as you already have 3 years of experience. So all you need is a diploma and then you can claim 5 points provided the assessing body gives you a positive skills assessment.

But if you cant do all this then you and your spouse have to apply for STNI or SIR as right now you only have 100 points.

Try to get 120 points.

You can get info about NAATI from here.

You basically have to pass an exam which makes you a NAATI certified interpreter or translator in one of the 27 national languages of Australia.

I think Hindi, Punjabi and Bengali are also on the list. Check if there are other regional Indian languages like Marathi and Tamil on the list as well.

So if the primary applicant passes the exam, the primary applicant gets 5 points.


Remember that all bonus points have to be claimed by the primary applicant. IELTS + NAATI + STNI etc.

The secondary applicant can only contribute 5 points towards the application by having his/her skills assessed by the respective assessing authority in a profession listed on the SOL/MODL.

You should get your skills assessed by the relevant authority for marketing. Dont worry if you do not have a degree.

You have work experience and that is what counts. Simply read the instructions given by the assessing authority and follow it.

Make sure you write proper english.

But if you have a diploma or trade certificate, that would count towards your assessment.

So instead of going for STNI, SIR I would recommend that you wait a little bit and try to apply firectly for PR.

But its up to you.

Your points for STNI and SIR are full and you can apply for them.

Just like you gave an ASCO code for your wife, what is the ASCO code for your occupation?

Is the occupation you work on, listed on the SOL/MODL?

If yes then your wife can claim points because you as her husband are skilled in a profession listed on the SOL/MODL.

But before she can claim points for your skills, you need to get yourself assessed by the relevant assessing body.

The name of the assessing body would be written next to the ASCO code on the SOL.

Every assessing body has given guidelines for applicants regarding how to send applications.

I know that you dont have a degree, but you do have experience.

So try getting yourself assessed by the assessing body of the profession you have worked in (provided your profession is also on the SOL/MODL)

The instructions for NAATI exam are listed on the website I gave you.

If you dont have any qualifications after your high school and your assessing body is requesting it then you can do the following.

1. Enrol in a 6 months course related to your field and after completing the course, you apply for assessment.

2. Apply for assessment without any course and hope they give you a positive skills assessment based on your work experience.

Try to write up reports regarding what you do in daily day to day tasks at your work and what you have learnt etc.

My husband and i have applied for australian PR. My husband is the primary applicant. Bein a chef, his occupation is on the MODL. Our applcation was lodged in Jan, 2007 but we still have not been allocated a case officer.People who applied after us have got case officers allocated. Constant follow-ups with the immigration office over phone, e-mail etc is not leading to any concrete reply on the status. Can you advise us on what is the best way to check on our status?

This is some thing very normal of the immigration department to bungle cases. I am surprised that a case officer has not been assigned to your husband despite the fact that your husband's occupation is on the MODL.

This happened with my brother as well.

But dont worry. Here are your options.

1. Write a letter to the Asia pacific region committee of the department demanding an explanation.

2. Write a letter to the Honorary Ombudsman and the Hon Parliamentary secretary for multicultural affairs and settlement programs.

explaining your situation and explaining lack of response from the immigration department despite your husband's profession being on the MODL.

There is no need to worry. This is a classic bureaucratic departmental red tape.

As a last option I would recommend that you hire a professional MARA qualified lawyer, which I did in my brother's case as well as my own case. I am in the process of becoming a MARA certified lawyer myself but at this stage I cannot handle your case.

The issue is that departments are very scared of lawyers because they know that the lawyers have the know how of the law and can get them in trouble. So the departments dont mess with lawyers. And that is the only reason I recommend lawyers to every one as they ensure that cases are not bungled as has happened in your case.

If you are the same Sandeep who contacted me earlier then please provide a break down of points so that I can know how you have concluded what your points are?

As per our last conversation, I think I mention to you that you have 100 points at this time.

Getting 7 in all bands of IELTS would only fetch you 10 more points and your total score would be 110. You still need 10 more to make it 120.

I have already explained how to get the extra bonus points.

Right now you are getting 100 points which makes you eligible for SIR and STNI.

I think as I explained earlier, the points for the primary applicant in your case are 100. I am not sure how you are coming to the conclusion of 120?

Please remember that the option of getting extra points for state/territory nomination is not available for visa 175. So you do get 120 points under the 176 visa. But you do not get 120 points under the 175 visa. As the points for state/territory nomination only helps in visa 176.

Yes, the Australian immigration department will go to any lengths to check whether the details you provided are genuine and that they are valid.

They will do a variety of checks to authenticate the information you have provided.

It can take a variable amount of time for the actual grant of visa.

No one can give you an accurate estimate as it is in the hands of the case officer.

Ans.1 Some times some employers are very fussy about permanent residency. So if you end up with an employer who definitely wants a permanent residency, then you are in for trouble.

But in most cases, employers only require work rights and 475 gives you unlimited work rights.

Ans.2: The rejection of visa depends upon many things. If your points are full, then there is no reason the case officer should reject your visa. If that happens, you can contact me.

Yes if the case officer doesnt find any wrong information and your points are enough for the visa category you are applying for, then you shouldnt be rejected a visa.

Yes, there are lots of recruiters who advertise jobs, but they dont help you in making your resume or preparing you for your interview.

You also need to work on your English language skills.

i) You can contact me and I with the help of my lawyer can fight your case.

ii) In case we are successful, we can guide and advise you on your future application.

2) Yes you will have to pay again for another application.

Its better to take advice from a lawyer and then lodge an application then to lodge one and get rejected wasting money and precious time.

If your company is changing its postal address, then you need to inform the immigration department of your new work address by filling in the relevant address change form.

Change of address doesnt affect the decision of grant of visa. However, you must inform the department on time.

The medicals are sent by the medical centre directly to the immigration department.

So may be you want to check that with the immigration department if they have received your medical tests or not.

Ok now that makes it clear.

I now see why your consultant is requesting you to apply for STNI and SIR.

The profession chosen by the primary applicant on the SOL is 2212-13. This profession has 50 points.

Now lets look up your total points.

IELTS: 15 points (If the primary applicant can take 7 in all modules, then the primary applicant will get 25 points.)

Nominated occupation: 50

Age: 30

Specific work experience: 5

Occupation in demand/Job Offer: 0

Australian qualification: 0

Australian work experience: 0

Language Skills/NAATI: 0

Regional Study: 0

State territory nomination: ?

Spouse/Partner: ?

Total Points = 100

Now if you can do two things

1. Get your spouse to get 7 in all bands of IELTS. That way the score of the primary applicant will go up to 110.

2. Then if you, the secondary applicant can also get a positive skills assessment from the respective assessing authority and nominate a profession on the SOL. That way the primary applicants point will go up to 115.

3. Now in the last step, if you can get 5 more points by getting nomination from a state/territory, the total points of the primary applicant will go to 120 and then you can apply for PR which means that you can live, work and study any where in Australia as long as you want. There are no restrictions on the PR visa.

But the primary applicant must get the extra 20 points as of now the primary applicant only has 100 points.

So try to get yourself assessed by the relevant assessing authority. You can do a diploma in marketing as you already have 3 years of experience. So all you need is a diploma and then you can claim 5 points provided the assessing body gives you a positive skills assessment.

But if you cant do all this then you and your spouse have to apply for STNI or SIR as right now you only have 100 points.

Try to get 120 points.

NOW ...my wife who is the primary applicant has answered her IELTS and this time she got the 7 on EACH band!.....i.e now she has got eligible for the 25 points right?

we shall be applying for sponsorship from NSW once we recieve the TRF..i.e in 3-4 days from today...

This is dependant upon the concerned department. The response time varies from case to case basis. No one except the case officer can give you an exact time frame.


2.are there any chances for rejection?

Not that I know of. If they do reject your case, contact me and I will put you in touch with my ex-lawyer. My brother was in a similar situation where by his STNI was rejected for no reason. My lawyer got it fixed.

So if some thing goes wrong, either talk to your consultant or if you have no consultant than contact me.


3.after the sponsorship is granted how long will it take to get the visa in hand?

Getting STNI is a separate process from getting PR. You can either get STNI,come to Australia and start working OR you can at the same time apply for PR as well. I am not sure whether once you get STNI and you enter Australia, then whether can cancel your STNI and take PR.

You should clear this with your consultant.

In case of my brother, he got STNI from South Australia and then waited for 9 months to get PR. He didnt take up SA's STNI.

Time taken for grant of visas is variable.

4. how are the job prospects in NSW based on the stni visa can we even be self employed??

That is a very subjective question. Job prospects are dependant upon a lot of factors such as job market, your skills and expertise etc etc.

Before you do any thing else, you should contact your case officer and demand an explanation as to what is happening with your case and why is it taking so long?

If that doesnt work, you should contact Mr Arun Garg. You can find his website at this address

Before I can advise you, I need to know the following questions

1. What is the profession you have chosen on the SOL/MODL?

2. Although the immigration department itself requires only one yr of work experience after your bachelor's degree, are you aware that your assessing body might have extra requirements for giving you a positive skills assessment. For example the Australian computer society requires overseas applicants to have at least 4 yrs of paid work experience in order to be eligible for assessment.

What is the total time required by your assessing body for giving you a positive skills assessment?

Suggestion:

I would suggest the following to you.

1. First get the work experience requirement of your assessing body.

2. Then fulfil that requirement and apply for PR.

3. Once you apply for offshore PR, you can come to Australia and study as an international student while your application is processed.

4. Coming to Australia as an international student is a costly venture, so if you can afford it, you are very much welcome. However, there are less expensive ways of coming to Australia.

Well this is exactly what they did to my brother without any reason.

My lawyer then sent an email to the department after which they apologised and granted STNI.

This is the reason I emphasise upon hiring lawyers. Spending $$ is nothing as compared to securing your future. Any mount you spend on your immigration will be easily earned back within a month when you come to Australia.

My brother spent a huge fortune on his immigration but now has a very well paid job and he got this job within one month of coming to Australia. What he spent on his immigration is just one month's worth pay in Australia.

All I can do at this stage is to recommend you to my lawyer.

If you can wait till Nov, I will have then qualified as a MAARA agent and then be able to take your case.

I have mentioned before that amount of time taken to process an applications varies.

No one can give you an estimated time.

Also if you are scoring the required points then I dont see any reason why your application will get rejected.

Before you apply make sure that you chose a profession on the SOL/MODL which is closely related to the degree you have done.

I checked the SOL and the closely related professions you can chose on the SOL/MODL are

Advertising specialist Code 22217-17 Points 50
Marketing specialist Code 2221-13 Points50
Sales and Marketing manager Code 1231-11 Points 60

So before you apply for your PR make sure you are able to obtain a positive skills assessment for one of the professions listed above.

Also two of the professions above only have 50 points. So if you are choosing any of the profession above then make sure you are able to make up for the extra 10 points.

Other then that, there is nothing else missing.

A permanent residency via is valid for 5 yrs. Once it expires, you can simply renew it.

The profession you have chosen on the SOL is worth 50 points. So make sure your points add up to 120.

Yes there is a process involved in getting yourself assessed from an assessing body.

If you look up the SOL at the following URL

http://www.immi.gov.au/allforms/pdf/1121i.pdf

You will find the name of a assessing body listed against your profession. You have to get yourself assessed from that assessing body as a qualified marketing specialist.

Note that your assessing body might have its own requirements before it gives you a positive skills assessment.

Your assessing body is http://www.vetassess.com.au/

So check the website and see if you can get a positive skills assessment as a marketing specialist based on your degree or not?

886 and 176 are two separate visas. You have to lodge two applications to apply for both of them.

176 is lodged in case you are applying from outside Australia on the basis of your experience.

886 is lodged when you are inside Australia and applying on the basis of your two yr study in Australia or work experience in Australia.

The end result is the same that both you the primary applicant and the secondary applicant get a PR visa.

Also getting a nomination from a state territory is different to getting PR. You first get STNI and then get 5 points for having STNI in your PR application.


Now coming to your question, YES, when you are granted a PR visa subclass 886 or 176, any secondary applicants will also be granted the same visa.

Spouse visas are only granted in case of temporary visas such as student visas or work visas.

You apply on the basis of STNI. STNI itself is not a visa. STNI means that a state territory is willing to nominate you/sponsor you. Thats all.

Having STNI fetches you 5 extra points when you apply for a permanent visa.

Yes, you can claim extra points for STNI while applying for visa sub-class 176 and 886. Simply tick the box saying "Yes I am claiming 5 points for having a state territory nomination."

You cannot claim points for having STNI while applying for visa sub-classes 175 and 885.

Whether you will be granted a visa or not and how soon the visa will be granted is up to the case officer.

No one else can inform you of the timing and date of grant of visa.

I am unaware of what PCC means.

Please contact your case officer in that regards.

1. Yes a case officer is normally assigned within 5 to 6 months.

2. Either do what your agent is asking you to do it or wait till you are assigned a case officer. The case officer will instruct you to submit what ever documents are required.

If you have paid for an agent then its better to listen to him.

In my view its better to have the documents ready and sent to the DIAC so that when a case officer is assigned, he doesnt have to ask you to submit this and that.

Every thing is ready and he can make the decision quickly.

PR visas are handled by a separate department while other visas have their own departments.

So your application goes in the PR visa queue and is handled accordingly.

Yes DIAC will do its own work checks.

STNI is not a visa, STNI is a process where by you are able to obtain 5 extra points for having a State Territory Nomination, STNI.

Once a state or territory has nominated you, you then apply for a visa like 175 or 176 and when you apply for it, you say that because you have a STNI, you are going to claim 5 extra points.

I am not sure how you can apply for both 176 and 886 at the same time.

I think you have only applied for 176.

The 176 visa has its own department and they handle all the applications.

Whether the 176 department handles the applications more quickly then the department of another visa like 573, the student visa, I am not sure as I am unaware of the internal working of the immigration department.

You should apply for offshore immigration and select the profession, 4941-13, Tailor.

You should get yourself assessed from TRA and then apply for offshore immigration.

Simple as that.

Did you include your son in the application?

If yes then contact the ASPC asking his name is not mentioned.

If your son was included as a secondary applicant in the application, then you are supposed to provide his medicals too.

No mentioning that you own the business and that you had two jobs doesnt matter.

Just keep it brief.

If you are claiming points for tailoring, you only need to show the work experience for tailoring. Dont mention uncessary things unless needed.

I am unaware of the procedure of including an unborn infant in the application.

You should contact your agent/case officer regarding this and explain that since you made the application, you have a son who you would like to be included in the application.

You will not be affected by the change in rules regarding IELTS.

You DO NOT NEED TO GIVE THE EXAM AGAIN. What ever the rules were at the time of your application applies to you.

My case is as follows: Me & my wife both are working. She is a trainer with a life insurance company and I am a brnch manager with a leading NBFC dealing in personal loans. I have applied for SIR visa (as suggested by our MARA agent) for South Australia through MARA agent( my wife being principal applicant). But after her skill assessement (which is positive her assigned occupation is management consultant ASCO CODE 2294-11, 50 point) we found that or agent was not competent enough for the job. So we decided to go on our own. We have received the hard copy of skills assesement from vetassess.
We both are MBA, she been in Finance & I in marketing. Following are points:
1) Age - She is getting 30 points (her running age is 28). I am also getting 30 points (my running age is 29)
2) IELTS - she is getting 15 points
3) Occupation - 50 points management consultant ASCO CODE 2294-11
4) State sponsorship - We are applying for the same in couple of days. If we get the same she will get 5 posints for it.
Her total is 100 points.

We both are having work exp of 4 years(she was having a break of 6 months in betweet due to accident).

my queries are as follows:
1) Are we eligble for PR considering our educational backgrounds and work expereinces? 2)At the time of skill asseseemnt our agent had put only her BBA degree (instead of MBA). He told us that her MBA degree will not be considered by the concerned assessing authority.Is he right?
3) I have my bachelor's degree in honours accounts. But our agnet told us since my university was not on govt of India site Australian authorities will not consider it.
4) As in my current profession I am Branch Manager with Leading NBFC dealing in personal loan I am looking afer the sales side(but in my salary slips and offer letter its written only branch manager) if I go for my skill asseseement will I consider my occupation as sales & marketing manager ASCO CODE1231-11 POINTS 60 OR Financial institution branch manager ASCO CODE 3211-13 40 points?
5) Can I apply for PR/SIR visa ?
6) We are going to apply for state sponsorship for South Australia what all documents we need to send in hard copy aprt from photo copy of passport, original of my wife skill assessement, original of her IELTS score sheet, discloser of attested net worth copy, her resume, research which we have done with regard to all aspects of living in south australia (around 40-45 pages), her resume & job application responce?

I first need to clarify a few misunderstandings you have regarding the immigration process.


We both are MBA, she been in Finance & I in marketing. Following are points:

If your wife has applied as the primary applicant for an immigration visa such as 175 or 176, then your contribution to the process is only in the form of 5 points which are awarded as "Skilled spouse" points.

So if you are the secondary applicant, all you have to do is to get yourself assessed by the respective assessing body in a profession listed on the SOL/MODL and your spouse will get extra 5 points while being assessed for the application.

Age - She is getting 30 points (her running age is 28). I am also getting 30 points (my running age is 29)

I am not sure why are you considering your age when you are not the primary applicant. All the matters is the age of the primary applicant. You are the secondary applicant and your age doesnt matter in the application. All that matters from your side as a secondary applicant is to get yourself positively assessed by the respective assessing body and claim 5 bonus points in the application of your spouse.

Then you can also claim points for specific work experience.

If your nominated occupation is worth 60 points and you have worked in your nominated occupation for at least the past three out of four years then you get 10 points.

So that brings the total to 110 points.

If your spouse can score band 7 in all modules of IETLS, you will be able to score 120 points and then apply for visa sub class 175 which has no restrictions.

If you cannot do that then you have to explore other options such as SIR visa.

Right now you are scoring less then 120 which makes you ineligible for the visa subclass 175.

2)At the time of skill asseseemnt our agent had put only her BBA degree (instead of MBA). He told us that her MBA degree will not be considered by the concerned assessing authority.Is he right?

I have not been involved with VETASSESS as yet but from my experience with AIM, I can tell that all that counts is a bachelor degree and what counts more is solid work experience.

Where was your MBA from? Can you get a letter from the ministry of education of your state or the federal gov of India that your degree is a valid degree?

If yes then that wont be a problem. The main thing is work experience.

The simple answer is that this depends upon the assessing body which is going to review your application.

Applicant applying under the profession code 1231-11 are assessed by Australian Institute of Management and they have their own criteria.

Applicants applying under the profession code 3211-13 are assessed by VETASSESS who have their own criteria.

So apply to AIM, if you are successful then you can lodge your application for the 60 points skill occupation.

5) Can I apply for PR/SIR visa ?

PR is a different visa. SIR is a different visa.

You cannot apply for PR as the primary applicant in your case is running short of points.

The immigration department website is right now not functioning so I will have to check up on the SIR later on.

If you think that the agent you hired didnt give your proper advice, then you can ask him to refund your consultancy fees.

If he refuses to do so you can write a complaint to MAARA and they will investigate.

In case you are proved right, you can claim compensation.

But the best would be to simply inform him to refund you your fees or you will lodge a complaint against him to MAARA.

Zoologist 2113-15 Points 50

Teacher secondary school 2413-11 Points 60

Since you also have a BEd, you can also apply as a Teacher of secondary school.

But if you want you can apply as a zoologist too. But if you apply as a teacher, you get more points.

So first you need to decide if you want to apply as a teacher or a zoologist?

The difference would be that in case of teacher, the assessing body is Teaching Australia, www.teachingaustralia.edu.au and your points would be 60 for your profession.

If you apply as a Zoologist, your assessing body would be VETASSESS and also your points would 50 for profession.

But first you will have to get yourself assessed from the respective assessing body. So it depends upon the assessing body to give you a positive skills assessment as a teacher or as a zoologist.

If you get a positive skill assessment as a zoologist, you go for zoologist.

If you get a positive skill assessment for teacher go for teacher.

I would recommend that you get yourself assessed from both assessing bodies. Who ever responds to you first, you can apply for that profession.

If both bodies give you a positive skills assessment, you can apply for both, but then you will have to lodge two applications which will cost more money.

Last of all, if you can apply for 176 permanent visa, why do you want to apply for temporary 475 visa?

As I said earlier, it is not DIAC which will decide whether you are a zoologist or not and whether your work experience is valid or not.

Its the assessing body which checks that.

The immigration department conducts checks like whether the information you provided is correct or not etc.

But make sure you double check the information I have given from some one else too.

To satisfy the basic requirements for immigration the website mentioned that
" Recent work experience requirement

To meet the recent work experience requirement, you must demonstrate that you have been employed in an occupation on the Skilled Occupation List (SOL) for 12 of the 24 months immediately before lodging your visa application.
(here they did not mention that work experience should be in ur nominated occupation)"

But if you want points for ur work experience(which r not required in my case) then there is specific work experience, and there are 2 options as-
1)If your nominated occupation is:
worth 60 points
and
you have been employed in your nominated occupation, or a closely related occupation listed on the SOL, for at least three (3) of the four (4) years immediately before you apply. Then u will get 10 points. and
2)If your nominated occupation is:
worth 40, 50 or 60 points
and
you have been employed in any occupation listed on the SOL, for at least three (3) of the four (4) years immediately before you apply.Then u will get 5 points.

Now if we concentrate on the 2nd point it is clear that our work experience need not to be in our nominated skill occupation, but it should be on SOL.

So what do u think, my work experience as a secondary school biology (zoology, botany) teacher(which is on sol) will be accepted if my nominated occupation is zoologist (zoology is among the subjects i teach along with botany)

The web page clearly mentions the following facts

1. You must nominate an occupation on the Skilled Occupation List (SOL) that is relevant to your skills and qualifications.

That is you cannot nominate a profession in which you dont have skills.


2. You cannot apply for this visa if your nominated occupation is not on the SOL.

3. Points awarded

You will only be awarded points for your nominated occupation if you meet the following:

* the occupation you nominate is on the SOL current at the time you make your application
* the relevant Australian assessing authority for your nominated skilled occupation determines that your skills are suitable for that occupation.


I hope that answers your question.


But if you want points for ur work experience(which r not required in my case) then there is

There are three things.

1. Work experience required to meet the criteria of the DIAC.

2. Work experience required to meet the criteria of the assessing bodies.

3. Work experience required to meet the criteria for claiming bonus points.

Dont mix the above three with each other. All three are different things.


So what do u think, my work experience as a secondary school biology (zoology, botany) teacher(which is on sol) will be accepted if my nominated occupation is zoologist (zoology is among the subjects i teach along with botany)

If you apply for the profession of teacher on SOL, DIAC will request your to get yourself assessed from the Teachers assessing body.

If you can get yourself assessed from the assessing body as a qualified teacher then DIAC will consider your application.

The process of immigration involves

1. Having oneself assessed from the relevant assessing body

2. Using that assessment as the basis of proving to the DIAC that you are skilled in the profession which you want to chose on the SOL/MODL.

Unless you get a green light from the assessing body, you will not be considered by the immigration department.

I understand that you have worked as a teacher. However, the case officer who will be handling your case would like to get a green light from the assessing body saying that "Mr Jaspal is a qualified teacher fit to teach in Australia at the secondary level."

I would suggest contacting an expert migration lawyer for further clarifying your doubts.

I would suggest you contact Dr Arun Garg, www.auslead.com.

He is a very qualified lawyer and was my lawyer too in my case and in my brother's case.

If he agrees that you can claim points for teacher profession without getting assessed from the teachers assessing body, then its fine.

Tell him that you are applying for Visa 475 and that although you will get yourself assessed as a Zoologist, you would like to claim points for teacher profession.

Ask him if its possible.

Its better to talk to him by phone since he is very busy and takes time to reply by email.

Sorry for not understanding your query before.

In my opinion, yes, your work experience of teaching Zoology can be considered by DIAC for GSM.

But you still have to get assessed from VETASSESS.

It is VETASSESS which will give you a positive skill assessment.

So you should be asking this question from VETASSESS.

In my opinion yes VETASSESS will accept that work experience as that befitting a professional Zoologist suitable for GSM.

Apply for assessment as a Zoologist to VETASSESS and wait for their reply.

If they give you a positive skill assessment then apply for visa 475 OR 176.

Yes you need to show good enough proof and evidence that you have researched the job market.

Use seek.com.au and other job sites to search for relevant jobs.

If you can contact employment agencies and get a letter from them saying that yes your prospects in Australia as a Zoologist are good, then that would add further weight to your application.

If you are going through a MARA lawyer then make sure he guides you about how to go about satisfying this particular criteria.

I think as clear from the information on the websites, you need to have at least one year work experience in the field you want to choose on the SOL/MODL and also fulfill the pre-requisites of the assessing body.

If you want to choose life sciences on the SOL then please read the requirements of the assessing body and see if you can fulfill the requirements.

For immigration purposes, try to remain strictly close to your occupation which I remember from my previous communication with you is Zoologist.

Once you come here, you can work in any thing.

As I said earlier, for immigration purposes, stay strictly close to your occupation on the SOL.

Dont try to jump to medical sales representative which is totally unrelated to the profession of Zoology.

If you dont stick to the profession you chose in your application, your application will get rejected.

This depends upon

1. Whether the application has been lodged or not.

2. Whether spouse skills points is some thing which is counted at the time of lodging the application or at the time of deciding the application.

If spouse skill points are counted at the time of lodging the application and you have already lodged the application then there is no use of getting your wife assessed.

If spouse skill points are counted at the time of deciding the application then go ahead as you will be able to claim bonus points.

If you have not lodged the application then get your wife assessed as you can claim bonus points if the profession is on the SOL/MODL.

Hi junaid, this is vipul again, last week I been to Panel Doctor for Medical examination, and this week Dr. Conformed that they sent medical report to Australia, now I m waiting for my PCC from India, but I have doubt that is there any chance for rejection of my case, my application is BN subclass 136 and my IELTS band is overall 6.5 and individual is 5.5 for all 4 modules and I submit my application24th august 2007 (before 1 Sept. 2007) If yes then in which base they can refuse my case? So I will prepare myself. Still I m working at the same place which I have shown my experience in application and I will continue until they do site verification. and one more thing for KRISHA...that as per DCIA site, all countries which are not ETA listed are High Risk Countries. India is one of the High Risk countries.

First of all I have done four year bachelors degree in Telecommunication Eng which completed in December 2007 and I have about 6 months job experience. I am a British citizen because of my parent being British citizen. I want to do masters in engineering in Australia and later apply for PR. For This reason I have applied for Masters in Telecommunication in university of Wollongong which is one year and I plan to do a diploma in business studies for one year for the two year rule.

Below are some of the questions that I have and if u could kindly help me with.

(1)I wish to apply on the basis of Skilled – Sponsored (Residence) visa (subclass 886) as my sister has a Australian citizenship and she can sponsor me. Is this visa plan/class okay?? and also I do not see Telecommunication Engineering in the SOL list and I have also read the PR for Engineering post so will I be able to get 60 points on basis of my bachelor’s?

(2)I also wanted to ask that if a did one year masters in telecommunication engineering from university of Wollongong and one year diploma in business studies will that fulfill the two year education requirement?? Also will the 60 points from two year education and 60 points for assement on my bachelor’s degree will add up to 120 points?

(3)Being a British citizen I have an assement level 1 for my student visa, so are there anything else that my nationality can help me in seeking PR status??

(4)Will an experience of about year help in me finding a job in Australia? Also if I do CCNA will it help me out?

(5)If I get two year of education in Australia, should I apply for PR right after I complete two year of education or before? If so will I be able to extend my visa if I am waiting for the outcome of my PR??

If the information you have provided is correct, then, Yes as far as the state sponsorship is concerned, you will not be required to sit again for IELTS, provided your application is accepted by the state.

The state will consider your application for sponsorship with your current IELTS score (I am assuming the state requirement is that of either general version OR the academic version of the IELTS.)


However please note that you will not be able to claim bonus points for English language skills from the immigration department as the DIAC's requirement for bonus points is to get band 7 in all modules of either academic or general version of IELTS.

Also you will need to acquire a positive skills assessment from your assessing body which may have its own requirements.

So you are dealing with three government bodies

i) The state of NSW
ii) The immigration department
iii) The assessing body which has been authorized to assess your skills and advise the two other bodies of your skills and competencies.

All three bodies are different and have their own requirements.

You need to fulfill the requirements of all three to be able to get a 176 visa.

That is what the media or the news paper stated. The immigration department is not that stupid. So dont worry, they will conduct normal check ups and will not just rely on one person only.

All you need to do is to sit and relax. Wait till you hear from DIAC.

Yes, seems fine for now. Provided you fulfill the rest of the points and conditions, you will be able to get PR. You will get 5 points for your sister being a citizen/resident.

The profession you choose on the SOL is dependent upon what profession Engineering Australia allocates to you.

Once your apply for assessment from Engineering Australia, Engineering Australia itself will allocate you a profession based on your education, skills and expertise.

You will have to then use that profession to lodging an application for PR.

By the way engineers Australia assesses people based on their bachelors degree. Your masters degree will not be considered by engineers Australia. So you can apply for assessment even now. The assessment is valid for your life time.

Yes that will fulfill the two year requirement, but one more requirement is that if you have done multiple degrees/diplomas, then all the degrees/diplomas must be closely related to the profession you choose on the SOL.

So your choosing a business degree might violate the "CLOSELY RELATED" rule.

You do not get points for two years education. Two years education is a pre-requisite for onshore application.

Your British citizenship can only help you in acquiring temporary work, study and visit visas.

For Permanent visas, every one, whether British or Pakistani has to stand in the queue and go through the same process.

Yes, I would highly recommend first getting a some work experience and as many certifications as possible. Other wise you will find it difficult to get a job.

You must apply for onshore application within 6 months of the release of your results.

Once your apply for PR, you will be granted a bridging visa which will be valid for the duration till the outcome of your application for PR. During this time you can stay and work in Australia. However, you would need to take permission if you want to leave the country.


My suggestion would be to try and take advantage of your British citizenship and get a work visa.

If you work in Australia for one year in a profession which is on SOL, then you can use that work experience to apply for PR.

Studying for two years is a huge waste of money and I would only suggest it if thats the only option.

You can also work in Pakistan/UK for one year in telco and then use that work experience for PR as well.


Studying for two years in Australia is a huge cost you would only want to bear if your dad is a rich guy.

Why do things the costly way when there is a cheaper way?

Yes, if the assessing body requires volunteer experience then you need to have/show volunteer experience.

I can only guide you in relation to immigration rules and regulations.

I am not very familiar with the rules and regulations of your assessing body.

At the end of the day you have to get a positive skill assessment from your assessing body.

Hi, this is Nits from India. Junaid I found your blog quite informative and I must say that you are hlping people like me in great way. Well me & my wife is trying for SIR subclass 475 for Adelaide. My wife being principal applicant and myself secondry applicant. We have got state sponsorship from SOuth Australia on 26th Sep'08. Request you to guide us with regard to following:

1) My wife (principal applicant) got a positive skills assessement from Vetassess for "Management Consultant". Also she has got state sponsorship from SA for visa subclass 475. We are going to lodge my visa application online. From 23rd of September 2008. Management Consulant is not there in SOL on which she was assessed and had got positive skill assessement. Will we able to get visa or due to this it would be rejected as my occupation is no more in SOL.

2) I (secondry) will be having IELTS exam on 11th October 2008 and last date of lodgement of visa application is 26th October 2008. Can i send IELTS laster on when asked?

3) In filing online application to claim points for specific work exp (5 points) there is no provision for my current job. In this how should principal applicant write the same as without her current job exp its is becomeing on 32 months rather than 36 months as required.

4) As we are fliling online application how to send the hard copies of various documents? Is there any provision on DIAC website to upload the same online?

Request you to guide us as we are doing entire process on our own.

1. Can my brother sponsor me even if he just mobed to Australia and is living in a rented house.

The IELTS requirement of the immigration department for teachers is a minimum of band 6 in academic OR general version of the test.

However, your assessing body might have different english language requirements.

Yes there are lots of opportunities in the teaching profession in Australia.

I would suggest you directly contact Dr Arun Garg asap.

I am on annual leave and not in Australia.

2. The secondary applicant can provide IELTS proof later on.

3. If the work experience of the primary applicant is less then 3 years in the last 4 years, then the primary applicant cannot claim bonus points for specific work experience.

4. The instructions for sending the documents will be provided by the department. Just follow the instructions.

1. Yes, initially only upload scanned copies. Make sure you follow the instructions of what format and what size the copies should be. If the case officer is suspicious, he would request original copies.

2. Yes it will be a good idea to send certified copies with the seal of certification on the front.

3. Yes you can send your husband's IELTS later. But your one must be given right now.

we r from india,and we r heading to NSW on VE 176. visa... i have a query we had lodged our application in july 2008. and told by my agent to front load the medicals after 2/3 months and we did our medicals on 14th oct 2008. i wud like to knw how long does it take for the medicals to get uploaded on the application status page??coz its been quiet some time and i have been checking my status on the immigration website..but it still shows outstanding....

The medicals dont get uploaded. The results of whether your medical has been cleared or not is updated.

If you have hired an agent then its better to ask him.

Hi junaid, this is vipul again from Kigali, I got my PR last week, now the question is do AU Govt. do any financial helps to new migrants’ for surviving until they settle or start JOB? Or any GOVT. hostel where I can stay for time being? And I search on net for the JOB, but 90% of job requires JOB NETWORK CARD, how can I obtain before reaching their? If there is any help centre for new migrants’ who can help them before arriving please let me know. Because I have to go along with my family (wife and two kids) and unfortunately I do not have any relatives or friends who can do such things on behalf of me before arriving AU.

No, unfortunately, the Australian gov doesn't provide any financial help.

As a matter of fact you are required not to seek any help for the next 2 years or so.

I am not aware of any hostels.

It would better if you first come yourself and once you are settled, you get your wife and kids to come over.

Having no job and no place to live, it would be a very risky thing to bring your family as well.

But your family must enter Australia before a specific date, mentioned on the visa label, or else your family's PR would be canceled.

I am not sure what is a job network card?

Which website are you searching?

Did VETASSES give you assessment based on your studies or studies + work experience?

If the assessment was based on study + work experience then DIAC will not object.

However if the assessment was based on only your degree, then DIAC might raise objection saying that your work experience is more of teaching and not of a zoologist.

I will have to confirm this with my senior and get back to you.

I cannot give you a yes or no answer so it would be better to wait till I have the answer or consult some one who is knowledgeable.

Plus make sure Zoologist is on the list of professions for SA as SA recently updated their list.

You can select a profession which is

1) On the SOL
2) AND you are able to obtain a positive skills assessment for that profession you have chosen
3) AND you have at least one year of work experience in that profession

Hi junaid, this is vipul from Kigali, before 2 weeks I received my PP with PR Visa Label and same time I received E-Mail from DIAC that I need to register on this WEBSITE https://skilledmigrant.gov.au/Welcome.aspx for skill migrant. (for job) but when I am using my VISA grant number to register this WEB Site it is not accepting and says that please enter valid VISA GRANT NUMBER. Wht could be the problem, I got conformation from my nearest AU High commission that I am using correct number. Please guide me for the same and can I work at NZ on same AU PR VISA status? Do I need to obtain any other VISA or permit to work in NZ?

I am not sure why your visa label is not getting accepted. Probably because you have not made your first entry in Australia and your label is not active.

Yes you can work in NZ using the same visa. You do not need another visa for NZ.

this is akash from india... had a query regarding my visa .. i have applied fot STNI visa subclass 176VE ( state sponsored) for NSW on july 22nd.. i sent my medicals to the DIAC in OCT n the medicals have been reached to them n has been updated in my file... i would like to knw when can i get a case officer... & how much time more it will take for me to get the visa??? you reply will be truly appreciated.

The time for processing is not fixed.

It can take any where between 8 to 13 months for a case officer to be assigned to you.

However, there is no fixed time and the department tries to process applications as soon as possible.

You can only show work experience in your nominated profession.

If you have work experience in another profession on the SOL, then you should nominate that profession for immigration.

Why nominate a profession on SOL in which you dont have any experience?

it is so because i was not able to get 7 each in IELTS required for teacher.
that is why i chose another occupation as my nominated occupation but want to show experience as a teacher.i contacted few MARA agents and they r saying it is feasible to do so. I just want a word of advice from u.

The process of immigration involves the following steps

1. Nominating a profession on the SOL.

2. Obtaining a positive skills assessment for the nominated profession.

3. Lodging the application with DIAC.

You cannot show work experience for profession A while your assessment and nomination is for profession B.

You can only show work experience in your nominated profession for which you must have assessment as well.

i wanted to enquire, whether the recent changes in the DIAC rules.. that State sponsosered 176 visa & CSL occupations will be given priority processing.. will this fasten up the processing of the STNI visa applicants...???i have applied STNI visa in july 08 for NSW.. will i be getting my CO much faster than the others who re not state sponsored???

Hi Akash, yes the professions on CSL and STNI will be given a preference.

At least that is what the gov is saying. Whether it is really implemented is yet to be seen.

The assigning of a case officer depends on the work load.

So yes according to the new rules, you should be assigned a case officer quickly.

No, this doesn't slow the process. The process is the same for every country. For some countries the time taken to verify documents is more then others.

Well this is what the website says, however, if you have been assigned a case officer, things would be pretty easy.

However, since this is a recent change, I am not able to comment much about it.

i have even heard that oct 2008 applicants are asked to immediately frontload thier pcc as well as medicals..

i have applied on july 2008 and have already sent my medicals but have to still send my pcc...do u advice i should send it right away .as still we have no case officer allocated to our application.

we are under (stni) 176 state sponsored by nsw... and we fall under the above category...

if u have any idea about the same kindly advice what should we do??

One advice. Dont listen to hear say but do keep your ears open.

Your ultimate source of information should be the Immigration website immi.gov.au and your case officer.

If you have not been assigned a case officer, then wait till you get one.

Your case officer will ask for all the documents you need.

What do you mean what you need to do?

If you have lodged your application then all you can do is to wait for a case officer to be assigned to you.

Well its been 6 months so you should have got a case officer. But wait till end of Feb and if there is still no case officer then send an email to Ombudsman. Some where on my blog there is a link to a web page where you can send an enquiry or a complaint.

What number are you going to call?

Use the internet. Its easy for them.

Make sure you mention your reference number/payment receipt number etc in your enquiry.

You should apply for immigration when you fulfil the following requirements

1. You have one yr of full time paid work experience in the profession you are going to select on the SOL.

2. You have a positive skills assessment from the relevant assessing body. In your case it is Engineering Australia.

3. You have achieved a minimum of 6 in all modules of IELTS.
