Australian Immigration for Dummies

This is the shortest most brief tutorial on Australian immigration.

There are three main categories of Skilled Australian Immigration.

1. Onshore immigration
2. Offshore immigration
3. Employer Sponsored (you can be in Australia or outside Australia)


In most cases, the end result of applying for immigration through offshore and onshore immigration is that you would receive the Permanent Resident Visa, class 885,886,175,176. And after having lived in Australia for four years(as of now), you can apply for Australian citizenship. In some cases you might receive Temporary Resident visas which allow you to work and live in Australia for a specific time. After having lived for the specific amount of time, you can then apply for Permanent residency. I will first deal with the onshore migration section and later on discuss the offshore one.
1. Onshore immigration. If you are in Australia

Skilled – Independent (Residence) visa (subclass 885)

A permanent visa for eligible overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study and for holders of certain temporary visas with skills in demand in Australia. Applicants are not sponsored and must pass a points test.

Skilled – Sponsored (Residence) visa (subclass 886)

A permanent visa for eligible overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study and for holders of certain temporary visas with skills in demand in Australia. For applicants not able to meet the Skilled – Independent pass mark, who have either a relative in Australia to sponsor them or a nomination from a State or Territory government. Applicants must pass a points test lower than that for the Skilled – Independent visa.

Skilled – Regional (Residence) visa (subclass 887)

A permanent visa for eligible provisional visa holders who have lived for at least two (2) years and worked for at least one (1) year in a Specified Regional Area in Australia.

Skilled – Regional Sponsored (Provisional) visa (subclass 487)

A three (3) year provisional visa for eligible overseas students and holders of certain temporary visas who can meet the lower pass mark for this visa. Applicants must be either sponsored by an eligible relative living in a designated area of Australia or nominated by a participating state/territory government. After living for two (2) years and working for at least one (1) year in a Specified Regional Area, applicants can apply for a permanent visa.

Skilled – Grduate Temporary Visa (subclass 485)

An 18 month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study. Allows applicants who are unable to pass the points test to remain in Australia for 18 months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa. No points test applies.


All the above categories are mainly designed for International students who have studied in Australia for two years OR for skilled people who are on various temporary resident visas and have skills which are in demand in Australia. Now we will discuss some of the offshore visa options.

2. Offshore immigration. If you are outside Australia

Skilled – Independent (Migrant) visa (subclass 175)

A permanent visa for people with skills in demand in the Australian labour market. Applicants are not sponsored and must pass a points test.

Skilled – Sponsored (Migrant) visa (subclass 176)

A permanent visa for people unable to meet the Skilled – Independent pass mark. Applicants must be either sponsored by an eligible relative living in Australia or nominated by a participating State or Territory government. Applicants must pass a points test lower than that for the Skilled – Independent visa.

Skilled – Regional Sponsored (Provisional) visa (subclass 475)

A three (3) year provisional visa for people who can meet the lower pass mark for this visa. Applicants must be either sponsored by an eligible relative living in a designated area of Australia or nominated by a participating state/territory government. After living for two (2) years and working for at least one (1) year in a Specified Regional Area, applicants can apply for a permanent visa.

Skilled – Recognised Graduate (Temporary) visa (subclass 476)

An 18 month temporary visa for graduates of recognised overseas educational institutions who have skills in demand in Australia. There is no points test for this visa. Employer Sponsored Immigration The employer sponsored immigration has three different categories.

Temporary Visas

For lawfully operating Australian and overseas employers to employ approved skilled workers for temporary vacancies in particular occupations required in Australia. Temporary visas can offer a pathway to a permanent visa.
Skilled Workers Temporary Visa Options

Temporary Business Long Stay – Standard Business Sponsorship (subclass 457)

A program for employers to sponsor approved skilled workers to work in Australia on a temporary visa. Employers can nominate a number of positions for different occupations under the same sponsorship application.

Service Sellers

For representatives of overseas suppliers of services who are negotiating, or entering into, agreements to supply their services in Australia under the General Agreement on Trade and Services (GATS).

Medical Practitioner visa (subclass 422)

Doctors should generally apply for a Temporary Business (Long Stay) visa (subclass 457) but this visa is an alternative for doctors registered to work in Australia. Employers must lodge a separate sponsorship application for each doctor sponsored.

Educational visa (subclass 418)

For educational workers to be employed in Australia on a temporary basis. The sponsoring organisation must be an Australian tertiary education or research institution, school or technical college.

Labour Agreements

Formal arrangements for an Australian industry group or employer to recruit a specified number of skilled workers on a temporary or permanent basis over a number of years.

Permanent Visas

For lawfully operating Australian employers to sponsor skilled workers in particular occupations required in Australia .

Skilled workers Permanent Visa Options

Employer Nomination Scheme (subclass 121/856)

For lawfully operating Australian employers to recruit workers on permanent visas, to fill full-time highly skilled positions which cannot be filled from the Australian labour market.

Regional Sponsored Migration Scheme (subclass 119/857)

For employers in regional Australia to employ skilled people in positions unable to be filled from the local labour market.

Labour Agreements

Formal arrangements for an Australian industry group or employer to recruit a specified number of skilled workers on a temporary or permanent basis over a number of years.

So this is a general overview of the three main pathways to Australian immigration. I will be posting more on immigration to Australia later on.

case is simple one and i am saying that i am from Pakistan and working in relevant area and will be completing one full time job experience in coming June inshAllah...so i dont have experience outside Pakistan.Plus main confusion lies in that specific work experience point distribution.that demands 3 out of last 4 years work experience...is that necessary???your help is appreciated...

Hi Junaid.during my stay in australia , i got skills assessed as electronics engineer after masters in Australia. now i left the country ,started working in software field since 1 year. do i need to re-assess my qualifications.will combination of electronics engineer + computers experience of 1 year work. i want to re-apply for PR.please ,let me know your opinion.

The MODL is valid until it is changed by the gov.

Your assessment as an electronics engineer from Engineering Council of Australia is a life time assessment. You do not need to get that reassessed.


Now the thing is that you didnt work as an electronics engineer, you are working as a IT person.

The definition of an electronics engineer is as follows.

While that of computer and IT professionals is as follows

So you see IT and engineering are two different professions as per the DIAC.

If your work experience doesnt match that of an electronics engineer then you need to get your skills assessed as that of a IT professional from ACS.

i am sandeep from india i had a query regarding my online applcation status, i checked my online application status today in which it is states:

04/02/09 Processing commenced further

In my document check list link... everthing says "MET" except for PCC( Penal Clearance Certificate) as i had not frontloaded my PCC.

THis changes were done today in the afternoon... but didnt recieve any mail from the DIAC / Case Officer....

Does these state tht i have a Case Officer???
if yes, when will the case officer contact me to upload my PCC.. & if he doesnt contact me how should i upload my PCC ..??coz i dnt knw who is my case officer... kindly guide me in this ...

I am unable to say if you have been assigned a case officer or not.

But surely your application is moving ahead.

Normally the case officer will ask you to send in the documents requested.

He will let you know where and how to send the PCC.


i forgot to write in the previous comment..once i send the PCC to my case officer, how much time will he take to grant me the visa..

There is no time frame, it is in the hands of CO to make a decision as CO seems suitable.

I was just surfing various sites for information on visa 176 for Canberra. I came across your blog and i found it quite informative and knowledge oriented.
I request you to help me out. Last year I had applied for SIR 475 for Adelaide. My Skill assessement was of marketing specialist and my IELTS score was 7.5 in each.
But my state sponsorship got rejected twice.
Fist time it was rejected stating that I had not maintained Aud$10000 in cash. It also stated they they will reconsider my application for state sponsorship again provided i maintain sufficient balance in cash.
But again when i reapplied with sufficient funds it got rejected stating that my research was not sufficient.
This all happened in the month of Aug'08.

In Sep'08 policies got chaneged and my marketing specialist job also got removed for the SOL of SA.

Recently i had a word with my agent and he told me that i should apply for visa 176 for canberra. And got my skills assessed for management consultant.
I am right now wokring in telcom sector in sales and prior to this I was working in financial sector.
My concern is that will i get positive skill assessement as "management consultant"(as my agent told me that it is the only job i can get positive skill assessement)?
Management consultant is a quota job for canberra. what is quota job and will i get into it if i get positive skill assessement for the same?
I am not at all aware about canberra with regard to job opportunites and living standard ?

You need to remember two things

1. You need to satisfy both the immigration department as well as the assessing body in order to obtain PR. Failure to comply with the requirements of the assessing body or the immigration department will make you ineligible for PR.

So you need to fulfil the pre-requisites of both the assessing body as well as the immigration department in order to get away with this whole process.

Management consultant is a quota job for canberra. what is quota job and will i get into it if i get positive skill assessement for the same?

Coming to your case, your assessing body is VETASSESS. VETASSESS does not assess work experience. It only assesses post secondary qualifications.

In other words, VETASSESS doesnt care whether your work experience is relevant to what you are nominating as your profession. It only looks at your degree and sees whether your degree is related to your nominated profession and then gives you an assessment.


So in order to get a positive skills assessment from VETASSESS you will need to have a qualification which is closely related to the profession of management consultant.

Once you have got a positive skills assessment from VETASSESS, you will lodge your application with the immigration department.

The immigration department gives a shit about your degree as long as you have one. It is more interested in your work experience. If your work experience is not related to what you have nominated on the SOL, your application will be rejected.

The definition of a management consultant can be found at the following URL.

So if you think that your current job work experience is what a management consultant is according to the above web link, then you will get through the immigration department as well.

Now before I can tell you whether your work experience matches that of a management consultant, I would need to see your resume with accurate details of all your past and current position.

I am not sure what you mean by quota job but I think you are referring to professions which are on the SOL of the states as well.

Certain states have shortage of certain types of skills. So they put that skill on their list.

I am not at all aware about canberra with regard to job opportunites and living standard ?

Job Opportunities depend upon your skills and abilities plus work experience. I am not sure how you measure living standards so unable to comment on that one.

Hi I have scored the following on my IELTS:

8.5,8.5,7.0,6.5 average 7.5

will this be considered 15 points or 25 points?
If its considered 15 points, its pretty unfortunate.

Yes unfortunately you are included in the 15 points range. You need to score 7 or above in all modules if you want to score 25 points.

on Feb 5th 2009, got acknowledged and money debited on feb 10th,but
problem aroused after that....i got a overall band score of 6 in IELTS...however
my score in listening module is 5.5.

After checking the immigration site i realized that i should score 6
in all modules...so i am planning to take IELTS again this weekend.
I Want to know whether my 2nd IELTS results will be considered by the case officer?
Or will my application be rejected since the first IELTS results didn't satisfy the english requirements?

Please clarify my question.

Yes your application will be rejected by the case officer if you have elected a non-trade profession such as accountant or IT profession.

If you have selected a trade profession such as plumber , cook , barber then your application will not be rejected.

You can check the information from this website

You must demonstrate that you meet the English language threshold. This means that you must already have your English language test results before you lodge your application.

All you do now is to request the department to withdraw your application and make a refund.

Its up to the department to make a refund or not.

I have seen many such cases where people dont consult with knowledgeable agents and then get in trouble.

If the profession you selected is a trades profession like barber, plumber etc then your application will not be rejected.

If the profession you selected is a non-trade profession like accounting IT etc then it will be rejected.

That depends upon how quickly you can get a job.

If you cannot get a job for 1 yr, you should bring funds which are enough for one yr.

Average monthly expense for two people will be $2000 AUD.

I have applied for SIR visa 475 for SA.I have got a mail from adelaide gsm office asking me to submit me and my wife medical and PCC.They have attached a letter also regading the same and mentioning CO name. Does it mean that CO has been assigned to me?

Another query I have is that at the time of PCC from regional passport office they asked us me and my spouse to change the passport details as our passports were issued prior to marriage and does not include the spouse name. We have done the same.
Due to this our passport numbers, addresses & names have been changeed. And I have lodged my visa application according to old passports details.

I have uploaded the same PCC along with form 929 for my self and my spouse. And also mailed them the certified copies of my new passports along with form 929.

Will CO accept the change of passport details and process my case?

You need to know the following things about applying for ONSHORE migration.


1. You should have studied in Australia for two academic years (92 weeks)

2. The course you studied in should be registered CRICOS course.

3. The course you studied should be closely related to a profession on the SOL/MODL.

4. You should be able to obtain a positive skills assessment for the profession you nominate on the SOL/MODL.

5. You should at least have a score of 6 in each module of IELTS exam.

6. You should score 120 points for 885 and 100 points for 886 visa.

Now how many of the above mentioned pre-requisites do you fulfill?

Also have a look at the SOL/MODL and let me know what profession will you nominate on the SOL.

You can only help your cousin to get PR if you are related to him in one of the following ways


a non-dependent child – including an adoptive or step-child

a parent – including adoptive or step–parent

a brother or sister – including adoptive or step-siblings

a niece or nephew – including adoptive or step–niece or nephew

an aunt or uncle – including adoptive or step–aunt or uncle

Since you are not related to your cousin in any of the above mentioned relations, you cannot sponsor him.

I have made a post lodgement enquiry about my visa and got a mail stating that only outstanding thing in my file is my PCC as they were not from correct authorities. I coundnt understand it as I have sent the right PCC form correct authorities.
I am confused as wht to do.
When I was lodging my file online in oct'08 I sent the police clerance,which was not actual as it was done only by police and not by regional passport office, I came to know this when CO sent me the mail asking for my PCC as my PCC was not right. After this mail I had frontloaded the right PCC done by regional passport office.
Is it possible than CO is geeting confused in both PCC(s).
I dont know how to contact them and tell the entire thing as my correct PCC is there in attachement on DIAC.
Please help.

Well, first you choose a uni.

Then you apply to it.

You get admission and then you pay the tuition fees and then you get visa.

Well if you had agreed to electronic correspondence, your visa officer would have contacted you by email.

If thats not the case, then lodge another inquiry and have your CO informed.

I found your blog very helpful. I need a little bit of clarification on visa 175 process.

On feb 2009 I submitted my application and alongwith it I have submitted all the relevant document proofs. The only thing that bothers me is I have not submitted the copy of my IELTS TRF sheet. Though I have mentioned the TRF number and date of IELTS somehow I forgot to attach the document copy and now its more than 2 month passed since lodgement. Is it going to impact my application or the proof will simply be asked when CO gets assigned to me.

As long as you appeared in an IELTS test and received its results before you lodged the application, every thing will be ok.

Just send the result sheet to CO when requested. Or if you have the option, upload a scanned copy electronically.

Need some help brother, actually i applied online through an agent and he did a mistake in filling the past employment's designation, but wrote the duties correctly according to my work experience. Now I m asking him to rectify the mistake and he told me that it will not create any problem because it is the work experience refrence which matters most and ur designation and duties are correctly written on ur work refrences, Please let me know if it is so.

Well if there is a mistake, then he can easily fix it without any fuss. All he has to do is to fill out a form and thats all.

There would not be any problem with this particular mistake unless the department even checks what was your designation.

If the designation you mentioned is different to what is mentioned to them in the check, it would create a delay in the process as they will start double checking every thing you have provided.

So the best is to make it easy for them to assess you and get all information corrected.

Thanx for ur response, well i had a telephonic conversation with Diac post lodgement enquiry office, they told me to send 1023 form through my agent, but my agent is not paying any attention to my problem. After this enquiry will Diac officer enter my queries and problem to my file, and if yes will it be available to my c/o. Can he refuse my application based on a single mistake.
Moreover Diac official told me to fill n send 956 form for terminating the appointment of agent, but i can't afford as my all the documents are with him, and i have already paid the full fee to my agent so he may create problems for me.
Please help me out, i m worried a lot.

No. As long as you inform them of the mistake. This is not such a big error but big enough to raise suspicions.

Is he a MARA certified agent? If yes then you can inform him that as per MARA rules and regulations, you are terminating his services and want all your documents back.

If he doesnt oblige then you can report him to MARA.

If he is not a MARA agent then bad luck. You will have to take him to court as per the regulations of your country. In Australia only MARA Agents can give migration advice. Any one who is not a MARA agent and is caught giving immigration advice can end up in jail.

Yes you can fill in the form yourself informing DIAC that you are terminating Agent X as your migration agent.

You can also report him to the DIAC if he doesnt return your papers.

However, I would suggest not to rely on emails. Call the agent and talk to him in person or meet him if possible. You have paid him the fees any way so its better to extract the benefit as well.

Could you tell me how is the job market in Adelaide in today's scenario. My entry date is upto feb'10. What would be the best time to go.
I am a bit skeptial as world wide economic conditios are in doom.
If i go how much min money is required for two people to survive for 12 months

Raahul here,
Yesterday i appeared for my medicals, i completed both the forms (160EH and 26EH) and went to panel doctor, and receptionist there told me that you have to sign in the presence of doctor, but the doctor got my signature once only, on one form only, and none on the other.
When i came back at home i realised that it is a big mistake, so today i called my doctor and he replied that we have sent ur reports, and further he said that we double check the forms before sending we did not find something wrong and u don.t worry.
I am worried in case i forgot to sign the declaration, or at other places in medical forms.
Will it affect my case or CO will simply send the medical forms back to get it signed or I have to reappear for medicals and spend a huge amount again.

If the mistake is really big, the CO will simply ask you to re-do the tests or may be get the documentation again.

2) If I send the documents to aspc, through email, will they acknowledge the receipt by email.
3) when the aspc recieves the medicals they immidiately update them or only co updates them.

There are some documents which are required within 28 days and there are others which the CO might request.

When you lodge the application it will give you a list of thigns required immediately/within 28 days/required on demand etc.

Yes if you send the documents via email, the aspc will confirm.

Given the work load I dont think so the medicals are uploaded instantly.

The medicals are sent by the doctors examining you. Not you yourself.

2) I had a talk with post lodgement officer about the mistake done by my agent, and that he is now declining to submit 1023 form (notice of incorrect answers), I further told the officer that I can not afford to part with my agent as my state sponsorship and my assessment are lying with him. Then the officer told me that I myself can send 1023 form through email to aspc, quoting my trn,tfull name, d.o.b., passport number, date of lodgement .
3) Can i send it right now, and will this form be accessible (visible) to my migration agent.
4) Can he willfully delete my form 1023, from my application by assessing it.

Once you send the form 1023 to inform the department that person A no longer represents you as an agent, the department will stop corresponding with him.

So you do not need to worry.

Just ask the agent to hand you over your documents. If he is a MARA agent he is bound by law to give you your documents back on termination of services.

I am interested in "Skilled – Recognised Graduate (Temporary) visa (subclass 476)" visa, Currently, I am studying in University of Adelaide (Singapore campus)as graduate diploma of Computer Science. After i checked the recoginsed institution in immigration website for that visa.My school is not listed there.

I just want to know, only institution under the list are eligible to apply? Or Is the list is keep updating?

Can I apply that visa even I am not graduate from those instituton?

Only students from institutions listed on the website are allowed to apply for 476 visa.

You cannot apply for it.
