For most General Skilled Migration visas, your application will be assessed against a points test. You can claim points under a range of different factors. The maximum points that can be claimed in any one factor reflects how valuable those characteristics are in the Australian labour market or in assisting settlement.
What is the pass mark?
The pass mark is the total points you need to score to be eligible for a points–tested General Skilled Migration visa.
What happens if you don't meet the pass mark?
If you have applied for a Skilled – Independent (Migrant) visa (subclass 175) or a Skilled – Sponsored (Migrant) visa (subclass 176) and you score below the pass mark, but above the 'pool mark', your application will be held 'in the pool' for up to two (2) years after assessment.
If the pass mark is lowered at any time in that two (2) year period, and your score is equal to or higher than the new pass mark, your application will be processed further.
Rather than waiting in the pool, you could consider the following visa options if you do not meet the pass mark:
- If you score 100 points you may be eligible for a Skilled – Sponsored (Migrant) visa (subclass 176) or a Skilled – Regional Sponsored (Provisional) visa (subclass 475) visa.

Before I applied on my own I had tried a MARA agent who, after taking the initial 20000/-, simply started avoiding me. Compared to him, I got real and prompt advice here. My bad luck I didn't get to know about you earlier.
By the way, ACS refused to change the ASCO code. They also refused to let me withdraw my application.

If you are not satisfied with the services of a MARA agent, you can have him reported to MARA.
You can also check if a person is MARA certified by looking up his name on the MARA register.

You are lucky that its only ACS you are in trouble with. Had it been the DIAC, there would have been lot of trouble.
Well if ACS is refusing to change the code then you need to lodge another application.

First of all, the course is not a 60 points course. It is the closely related profession on the SOL which is of 60 points. There is a relationship between the two but there is also a difference.
Once your current student visa expires in two years and you also dont have PR then you will have to leave Australia or apply for a graduate skilled visa OR apply for PR based on your two years study.
But that would be a waste of another $2000 AUD.

With the recent changes brought to the Skilled Migration Program and introduction of the priority processing of applications in the order of -
1. State/Territory sponsored Applications,
2. CSL occupations,
3. MODL occupations,
4. All other applications.
I applied for my SIR 475 visa on 13TH Feb 2009 (online application) through an agent.
I understand that Australia's fiscal year starts from July and ends in June the following year.
Looking at the websites and forums where people who have got their visas are putting up their timelines, it is now clear that they have dealt with all state sponsored applications and have moved on to CSL list.
My question is - Does this means the remaining state sponsored applications will be dealt in the next fiscal year starting from July 2009?
There is certainly scope of confusion left by DIACs and unexplained reasons for some getting their visas too early and some very late.

Dont rely on those timelines.
There are no hard and fast rules for processing these applications.
Your application can be stuck for any number of reasons. Or might be waiting for approval or clearance.
You have just lodged the application two months ago. So there is still lots of time to wait.

Ok my question is that i have done my IELTS test and i have scored an overall band of 7 as follows:

Listening:8
Reading: 5.5

You need to score at least 6 in each module to be eligible for PR.
As your score in reading is less then 6, you cannot apply for PR.
However, if your profession is a trades profession then you can apply for PR.

regards I really cannot say much about your agent and what the deal between you two is.
If you are not happy with him, simply inform the department that you do not want his services any more and that the department should contact your directly.
If your agent is a MARA agent, you can take him to court by informing MARA of his misconduct.
If you have come through a non-MARA agent then bad luck. You cannot do any thing. However if he is some one who lives in Australia and is giving migration advice without being a MARA agent, you can take him to court.
If you want, I can request my boss to examine your case and if he wants he can take your case too. Let me know what you want.
Coming to your question about your wife. If she cannot score IELTS then you will have to pay additional $2925 for her English language course.

Whether your skills are the same as that of the profession on MODL depends upon whether ACS accepts your work as a Java or Oracle specialist or not.
You can check the website of ACS for further checking out what ACS expects from a Java or Oracle professional.
Just stating that you have experience in Java or Oracle is not sufficient for me to give you a yes or no answer.
You need to provide a complete detail of what you do in your job.

Hey Junaid, remember me? lol.. Anyway, the 175 visa with failed IELTS requirements has been refused by the case officer as i expected. But then in February, I lodged another one.. 175.. but in mid march, i applied for queensland state sponsorship and i was successfully granted. So my application now is i76, I just wanted to know how long do i have to wait now that i have a case officer and submitted the final requirements she asked which is the police clearance? Its just weird though, same case officer assessed my 2 applications. hehe.

As long as the case officer takes to decide.
But normally it is 2 to 3 months after being assigned a case officer.

Once you have nominated the profession then you need to check whether your degree will enable you to get a positive skills assessment from the assessing body or not? The name of each assessing body is listed next to each profession.
The number of points are also listed against each profession.

I am Vaibhav from melbourne. I have been studying Hospitality diploma here from last year.It still needs six months to be completed. In the mean time I sat for tha IELTS exam and with God's grace I am successful in acheiving 7 bands in all the four modules and overall 8 Bands. But I still have one question in mu mind that "Can Diac refuse PR if I have satisfied 120 points criterea"
My Points will be as follows according to DIAC site:
Course-60 Points
Age- 30 Points
Australian Education- 5 Points (two years full time study)
Ielts- 25 Points (7 Bands or more)
Thats comes up to be excatly 120 points and probably i will lodging my PR application by the start of next year. So Are there any chances of refusal on the basis of points if all others requirments like medical and other things are cleared.
Or any suggestions to make my application stronger in order to get it approved.

An application can be rejected for many reasons e.g.
1. Using the wrong form to lodge the application.
2. Not applying within the specified time.
3. Lodging the application at the wrong place.
etc etc.
You are scoring 120 points so every thing would be ok provided you fulfill all the rest of the requirements as well like studying for 92 weeks in a CRICOS course which is closely related to a profession you will nominate on the SOL.
So before you lodge the application consult a good lawyer and show him your documents etc and make sure every thing is in place before you lodge your application yourself.
The best would be to use the services of a lawyer. If you have already spent 20,000 AUD there is no harm spending another 2000 to secure your future.

The thing which is listed on the SOL is not a course or a degree but a profession.
You need to nominate a profession on the SOL which is closely related to your two yr study.

Firstly the SOL list changes july 2010, which takes my course out of the SOL list. But i have been in Aus for 2 years, and in mid 2011, it will be 3 years. over this period of time i will have completed a bachelors ( 1 year) and a masters degree (2 yrs) in Australia (adelaide). what are my chances of getting a PR... what should i do? i don't want to waste all the time, money and effort i have put in these last 3 (will be) years ...

Your answer is questioned in the following FAQ.
I am an international student who was planning to apply for a GSM visa at the completion of my
course of study. My intended occupation is not on the new list of occupations. Would I be affected by the proposed changes?
You would not be eligible to apply for a permanent or provisional GSM visa unless your nominated occupation is on the SOL that is in effect at the time you seek to lodge your application.
However, it is proposed that if on 8 February 2010 you held a Subclass 572 (Vocational Education and Training Sector) visa, a Subclass 573 (Higher Education Sector) visa or a Subclass 574 (Postgraduate Research Sector) visa, you would still be able to apply for a Subclass 485 (Skilled Graduate) visa.
This is intended to be the case even if your nominated occupation is not on the new list of occupations, provided that you apply before 31 December 2012 and nominate an occupation that is on the current SOL. The current SOL contains more than 400 occupations and is available on the department’s website.

This would allow you to gain valuable work experience in Australia and the opportunity to secure an employer or a state/territory government sponsorship.

Alright. I have a subclass 573 visa and my (masters degree) course ends July 2011. Now i have done another (bachelors degree) course in 2008-2009 with the same visa subclass category. i visited a (MARA) agent in Feb 2009 and they advised me that doing a combination (bachelors + masters) over 3 years would get me an additional 10 points. if this is the case, i will have 120 points by the end of my course. The confusion is, how do I know my course points as of now, and how is this related to the SOL. Also, does this mean that even if i have the required points I cannot apply for PR because my occupation is no more on the SOL.

You will get 15 points if you have undertaken study for a period totalling at least three (3) years, during which you:

You are under the impression that you get points for studying in a particular course. WRONG.
You get points for nominating a profession on the SOL.
The rule is that
1. Your degree(s)/diploma(s) should be closely related to the profession you nominate on the SOL.
AND
2. You should be able to obtain a positive skills assessment from the respective assessing body of the profession you have nominated.
The assessing body might or might now give you a positive skills assessment on the basis of your degree. Every assessing body has its own rules and regulations.
If you are an accountant, you can obtain a positive skills assessment from three assessing bodies. CPAA/ICAA/NIA
Contact the assessing bodies to figure out whether they will give you a positive skills assessment or not.

Yes you can certainly apply for offshore immigration from Pakistan as well if you have work experience.
You do not need 4 years work experience. You only need one year of work experience as far as the immigration department is concerned.
However, your assessing body may require you to have more work experience.

No. CCNA does not have any points on the immigration system. A diploma or a degree is what have points on the immigration system.

I would have finished my advanced diploma with a duration of 2 years, I will be sponsored by a close relative who'd been a citizen of Australia for decades, my IELTS OBS is 8, 8 in reading,speaking and listening and 7.5 in writing.
I live and study in Adelaide. If I may ask, I have a bachelors degree in nursing from the Philippines, would that give me additional points? The said degree was taught using filipino and english language.
The only downside would be, I have no work experience related to any of my studies.

You cannot claim any points because you will be nominating a profession on the SOL which is not NURSING.

Need help desperately cause i'm really confused right now. I have done an intensive background research but there are some things that I just cannot clarify. I need an expert opinion and I reckon your really well versed with the topic, so I thought I'll give it a shot.
Two things, the old points system expiring June 2011 and the new points system starting July 2011. I am a hospitality management graduate and clearly my profession isn't on the new SOL list. However a Hotel/Motel manager was on the old list. I did a bachelors degree for one year and I am at the end of my two years masters course in hospitality management. Before I get into details, I just wanted to know how many points could I accumulate for this course/profession if any? Do I need to show supervisory/managerial experience to be eligible for my PR and if yes, for how long? I will pester you with other details only there is some hope regarding this situation. Ravin, the points for every profession is listed next to its name on the SOL. That is the points you get for nominating a particular profession.

485 is an onshore visa and requires that you be holding a current student visa to be able to apply for 485.
Since you are not holding a student visa, currently, you cannot apply for 485.

That is correct. You will get a work permit for at least 2 years and maximum of 4 yrs after studying in MPH for at least 2 yrs.

You are assuming that you will get a job in your field for 2 yrs. If you can get a job related to a profession on the SOL, then yes you can apply for PR based on that work experience.
But you need to check what profession you are to nominate for applying for PR. Your profession might require more than 2 yrs of work experience as a requirement for PR.
Also, your profession might also have other specific requirements.
So you need to first tell me what profession you are going to nominate for applying for PR.
You can get a list of all the professions on the SOL.

2. I have a total experience 10+ years of experience in same profession ( i.e design )
3. Qualifications I have :
a. Bachelors in Arts
b. PG Diploma in Computer Applications
c. Diploma in Multimedia (2yrs)
d. Diploma in Animation & Special FX (1yr)
e. Some Certifications
4. I am 30 & married. My spouse is having Masters degree in communications. She even has a work experience of about 8 years
5. We are having a kid of 3yrs
6. Do you think we can apply for PR ? as I don't see any Designers required in SOL.
7. Do I need to have employement offer from some employer in Australia for PR ?
8. How much expensive it would be ?
9. Would it be a wise decision to make a move ?

I have not had a look at SOL for quite some time but if there is no profession on SOL which is CLOSELY related to your current profession or your wife's current profession then you CANNOT apply for PR.
The very first requirement of applying for PR is that you have a profession on SOL which is closely related to what you are doing right now.

No. You do not need employment offer to apply for PR. You need
1) to have a offer from EOI
2) to be able to score the pass marks on the points test
3) to be able to fulfill other requirements such as English language requirements etc

Visa subclass 176 is a permanent visa so your marital status has no effect on the validity of the visa.
However, if this visa was granted due to state territory nomination then you must live in the respective state territory for at least 2 yrs. Other wise if you keep living outside Australia, then your visa will not be renewed at the end of its 5 yrs validity period.
The best option will be to live in Australia for 4 yrs and get your citizenship.
The second best option will be to at least live in Australia for 2 yrs in the state territory that sponsored you so that at least you can renew your PR visa.

I want my spouse to be secondary applicant, she is external auditor and she got IELTS 7(s),6(r),7(w),7(l). She has bachelors degree in finance. I want to asses her qualification, and in her case CPA will be the assessment body.
My question is does she need(secondary applicant) 7 bands in each modules of ielts or 6 bands are enough.

Assuming you have applied for skilled visa 189, your spouse needs to have the following requirements for you to be able to claim points.
You can receive five points if, when you are invited to apply for this visa, your partner provides evidence that they:
were under 50 years of age
had at least competent English
had nominated an occupation on the same skilled occupation list as your nominated occupation
had been assessed by the relevant assessing authority as having suitable skills for the nominated occupation.

You have achieved a score of at least 6 in each of the four test components (speaking, reading, listening and writing) in an International English Language Testing System (IELTS) test that has been undertaken in the three years immediately prior to lodging the visa application.
So yes 6 is enough from Immigration department point of view but CPA may require a higher score.
